TERMS AND CONDITIONS OF USE


This page (together with the documents referred to on it) tells you the terms of use on which you may make use of our website www.thegoodguide.com (“Site”), whether as a guest or a registered user (“Terms”). Please read these Terms carefully before you start to use the Site. By using our Site, you indicate that you accept these Terms and that you agree to abide by them. If you do not agree to these Terms, please do not use our Site.

The Site is owned and operated by thegoodguide.com Limited (“We”, “Us” and “Our”). We are registered in England and Wales under company number 06264829 and have our registered office at 27 Old Gloucester Street, London, WC1N 3XX. Our VAT number is 928 1302 39.
 
Registration

 

People who register with our Site become "Guides". They must be at least 13 years of age.

 

You must register on the Site using accurate and current information about yourself – including your correct name, email address and any other requested details.

 

During registration, you will select a username which will be associated with your use of the Site. This username can be used as a method of linking to your profile and for other uses that we may make available for usernames.
 

We reserve the right to remove or revoke the use of a username previously selected by a user, if it is inappropriate, a registered trade mark of a third party, a special keyword which is required for other uses, or for any other reason whatsoever. We are under no obligation to disclose to you our reasons for revoking your use of a specific username.

 

We reserve the right to suspend or terminate your account if any information provided during the registration process or thereafter proves to be inaccurate, not current or incomplete.

 

You are responsible for safeguarding your password and you must treat it as confidential. You agree not to disclose your password to any third party and to take sole responsibility for any activities or actions under your account, whether or not you have authorised such activities or actions. You will immediately notify us of any unauthorised use of your account.
 
 
Accessing and using our Site

 

This Site is provided for users to share information, ask questions and give answers about topical issues, countries, related travel and general information.

 

Any access to or use of the Site by anyone under 13 years of age is expressly prohibited. By accessing or using the Site you represent and warrant that you are at least 13 years of age

 

Access to our Site is permitted on a temporary basis, and we reserve the right to withdraw or amend the service we provide on our Site without notice. We will not be liable if for any reason our Site is unavailable at any time or for any period.

 

We aim to update our Site regularly, and may change the content at any time. Any of the material on our Site may be out of date at any given time, and we are under no obligation to update such material.

 

From time to time, we may restrict access to some parts of our Site, or our entire Site, to users who have registered with us.

You may use our Site only for lawful purposes. You may not use our Site:

To impersonate or misrepresent your affiliation with any person or entity;

For any commercial purpose or for the benefit of any third party or in any manner not permitted by these Terms.

 

You also agree:

Not to reproduce, duplicate, copy or re-sell any part of our Site in contravention of these Terms.

Not to attempt to gain unauthorised access to our Site, the server on which our Site is stored or any server, computer or database connected to our Site. You must not attack our Site via a denial-of-service attack or a distributed denial-of service attack.

Not to access without authority, interfere with, damage or disrupt:

any part of our Site;

any equipment or network on which our Site is stored;

any software used in the provision of our Site; or

any equipment or network or software owned or used by any third party.

 
Uploading content to our Site

 

We provide interactive services on our Site and encourage you to upload comments and other information and materials (“Contributions”) for the benefit of other users.

 

You can choose not to receive anonymous questions via the Site. If you wish to opt out of receiving anonymous questions via your account, please update your “Account Settings” and select the option “Don’t Allow Any Anonymous Questions”. Whenever you make use of our interactive services by uploading Contributions to our Site, the Content Standards will apply.

 

We will not be responsible, or liable to any third party, for the content or accuracy of any Contributions posted by you or any other user of our site.

 

We have the right to remove any Contributions on our Site if, in our opinion, such Contributions do not comply with the Content Standards or any other part of these Terms, or is otherwise unacceptable. You warrant that any Contributions posted to our Site by you comply with the Content Standards.

Be likely to deceive any person;

Be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence;

Promote any illegal activity;

Be threatening, abuse or invade another’s privacy, or cause annoyance, inconvenience or needless anxiety;

Be likely to harass, upset, embarrass, alarm or annoy any other person;

Be used to impersonate any person, or to misrepresent your identity or affiliation with any person; or

Advocate, promote or assist any unlawful act such as (by way of example only) copyright infringement or computer misuse.

 

Reliance on information posted

 

Commentary and other materials posted on our Site are not intended to amount to advice on which reliance should be placed. We therefore disclaim all liability and responsibility arising from any reliance placed on such materials by any visitor to our Site, or by anyone who may be informed of any of its contents.

 

Interactions between Guides

You are solely responsible for any interactions you have (including any disputes) with other Guides. You understand that we do not in any way screen Guides. You are solely responsible for, and will exercise caution, discretion, common sense and judgment in, using the Site and disclosing personal information to other Guides. You agree to take reasonable precautions in all interactions with other Guides, particularly if you decide to meet a Guide offline, or in person. Your use of the Site and any other content made available through the Site is at your sole risk and discretion and we hereby disclaim any and all liability to you or any third party. We reserve the right to contact Guides, in compliance with applicable law, in order to evaluate compliance with the rules and policies in these Terms. You will cooperate fully with us to investigate any suspected unlawful, fraudulent or improper activity on the Site.

 

Intellectual property rights

 

We are the owner or the licensee of all intellectual property rights in our Site, and in the material published on it. Those works are protected by copyright laws and treaties around the world. All such rights are reserved.

 

Any material contributions you post to our Site will be considered non-confidential and non-proprietary. When you post Contributions, you expressly grant us a perpetual, unlimited free license to republish that Contribution on our Site and to publish/use/modify/redistribute/make available and/or sell that text in print or electronic form anywhere in the world as part of an edited compilation or otherwise for any purpose.

 

You may print off one copy, and may download extracts, of any page(s) from our Site for your personal reference and you may draw the attention of others to material on our Site, but you must not use these for any commercial purposes.

All Feedback will be treated as a Contribution for the purposes of intellectual property rights ownership.

You may link to our home page and your personal profile page on the Site, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

 

You must not establish a link from any website that is not owned by you.

 

Our Site must not be framed on any other site, nor may you create a link to any part of our Site other than the home page and your personal profile page on the Site. We reserve the right to withdraw linking permission without notice. The website from which you are linking must comply in all respects with the Content Standards.

Suspension and termination

 

We will determine, in our discretion, whether there has been a breach of these Terms through your use of our Site. When a breach of these Terms has occurred, we may take such action as we deem appropriate, including taking all or any of the following actions:
 
Immediate, temporary or permanent withdrawal of your right to use our Site;
Disable any user identification code or password for our Site;
Immediate, temporary or permanent removal of any Contributions uploaded by you to our Site;
Issue of a warning to you;
Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach;
Further legal action against you; and
Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.


The actions set out above are not limited, and we may take any other action we reasonably deem appropriate.

 

Jurisdiction and applicable law

 

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our Site, although we retain the right to bring proceedings against you for breach of these conditions in your country of residence or any other relevant country. 

 

These Terms and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the law of England and Wales.

 

Changes to the Terms and Conditions

Your concerns and alerting us

 

We do not monitor use of the Site or edit any content updated by users. However, if you have any complaints or objections to any content or material posted, please inform us by “flagging it”, using the “report abuse” functionality or contacting us at help@thegoodguide.com and we will review that specific content. We will use reasonable endeavours to remove any illegal content within a reasonable time of it being brought to our attention.
